Our San Francisco deportation defense attorneys have extensive experience handling all types of deportation matters, including the various options for relief. Who Is Eligible for Cancellation of Removal?

If you meet certain eligibility requirements, it may be possible to have your removal order canceled.

You may be eligible for cancellation of removal if you:

  • Have been a permanent legal resident (green card holder) for at least five years
  • Have lived in the U.S. continuously for at least seven years prior to the order of removal
  • Have been in the U.S. for ten or more years and are of good moral character
  • Have never been convicted of an aggravated felony in the U.S.
  • Can demonstrate that your removal would cause exceptional hardship for a spouse, child, or parent (if they are lawful, U.S. citizens or permanent residents)
  • Are the victim of domestic violence by a spouse or parent or your child is the victim of domestic violence by a legal, U.S. permanent resident or citizen

If you have been convicted of a crime, including illegally entering the U.S. or remaining in the U.S. unlawfully (amongst others), it can be incredibly difficult to have your removal order canceled. It’s wise to speak with a deportation defense lawyer in San Francisco who can help you understand your options.
