Three EB-1 Visa Classifications

The EB-1 employment-based first-preference category covers three distinct groups. Each classification has different standards for accomplishments, employment, sponsorship, and qualifying relationships, so identifying the correct category is an essential first step.

Extraordinary Ability

Applicants in this category must demonstrate sustained national or international acclaim in the sciences, arts, education, business, or athletics. An applicant generally must satisfy at least three of 10 regulatory criteria unless the record includes a one-time major achievement, such as a Pulitzer Prize, Academy Award, or Olympic medal.

This classification doesn’t require a job offer or labor certification. Applicants must intend to continue working in their field, and they may file Form I-140, Petition for Alien Worker, without employer sponsorship.

Outstanding Professors & Researchers

Outstanding professors and researchers must demonstrate international recognition and at least three years of teaching or research experience. They also need an offer for a qualifying teaching or research position and must satisfy at least two of six listed evidentiary criteria.

The employer files the petition for this classification and must demonstrate a continuing ability to pay the offered wage beginning on the petition’s priority date. That date establishes the applicant’s place in the immigrant visa process.

Multinational Executives & Managers

A multinational executive or manager generally must have worked outside the United States for at least one year during the three years preceding the petition. The position and employment history must satisfy the requirements for executive or managerial work.

The petition requires a qualifying relationship between the U.S. employer and the foreign entity. The petitioning employer also must have been doing business for at least one year. These requirements are distinct from those governing extraordinary ability applicants and outstanding professors or researchers.

Building a Strong EB-1A Petition

EB-1A is reserved for applicants who have risen to the top of their field through sustained national or international acclaim. Meeting three regulatory criteria alone doesn’t establish eligibility. The full record must substantiate the claimed achievements and place them in the context of the applicant’s field.

Effective petition documentation should clearly establish:

  • The applicant’s field: The evidence should define the area in which the applicant has earned recognition.
  • The relevant achievement: Each record should identify the accomplishment or recognition it documents.
  • The regulatory connection: The filing should show how the submitted material supports the criteria being claimed.
  • Continued work: The petition should address the applicant’s intention to continue working in the field.

EB-1A applicants can self-petition, so an employer doesn’t need to file Form I-140. Our EB-1 visa lawyer works with applicants to gather and organize records that support the petition under applicable USCIS standards.

Our EB-1 Petition Process for Oakland Clients

Our process begins with a consultation focused on the proposed classification and the facts relevant to eligibility. We then provide individualized guidance through petition preparation, applying the requirements of the appropriate EB-1 category.

Our five-stage EB-1 process includes:

  • Initial eligibility consultation: We assess the applicant’s background and the classification under consideration.
  • Documentation gathering: We assist with collecting the records needed for the EB-1 petition.
  • Application preparation: We prepare the filing to meet USCIS standards.
  • Form I-140 filing: We file the Petition for Alien Worker for the applicable EB-1 classification.
  • Continued support: After approval, we provide support toward permanent residency.

EB-1 Timelines, Costs & Consultation Requirements

Immigration filing timelines vary based on case-specific facts, government processing, and the filings required. We don’t provide a processing estimate before examining the case because the relevant variables differ from one petition to another.

Legal representation costs depend on the scope and complexity of the case. We require a consultation fee for our 100% confidential consultations. The consultation allows prospective clients to review eligibility questions and documentation needs before deciding how to proceed.
